If you believe content on Fluxer infringes your copyright or another intellectual property right, email copyright@fluxer.com. In the EU, you can use the form at fluxer.com/report instead and pick the copyright or intellectual property option.
We review each complaint under the laws that apply to it, including EU law.
Fluxer has none of the messages or files on a self-hosted instance, and a complaint about content there goes to the people who run that instance.
How to submit a complaint
When you write your complaint, please do all of the following.
- Tell us what the protected work or right is.
- Tell us where the material is, such as message links or channel and user IDs.
- Explain why you believe it infringes your rights or is otherwise unlawful.
- Give us your full name, email address and any contact details we should use.
- Confirm that you believe in good faith that the way the material is used isn't authorized by the rights holder, the rights holder's agent or the law.
- Confirm that your complaint is accurate and complete and, where applicable, that you're the rights holder or someone authorized to act on their behalf.
- Sign it with your physical or electronic signature.
We can't always act on a complaint that doesn't make clear which material it's about, or that doesn't explain why the material infringes your rights or is unlawful.
How we review complaints
Where a complaint gives us enough to act on, we may remove the material, disable or limit access to it, limit its visibility, restrict account features, or suspend or terminate the account responsible, depending on the facts of the case and the applicable law.
Section 3.4 of our terms explains the statement of reasons the affected user gets, which can say who the rights holder is. We don't give that user your email address, postal address, signature or other direct contact details unless the law requires it. Where we can, we tell you the outcome, as far as legal, privacy, security and confidentiality limits allow.
If you want to use a pseudonym or act through an authorized representative, such as a law firm or a rights protection service, please say so when you submit your complaint.
Appeals and complaints about decisions
You can challenge a decision if you believe your content was removed or restricted through an error or mistaken identification. In your appeal, tell us which content was affected and, where possible, where it was before we took action. Explain why you think the decision was wrong, and give us your full name, email address and physical or electronic signature.
Section 6.2 of our terms explains how appeals are reviewed. Applicable law may also give you the right to go to court or use another dispute resolution process.
Misuse of the reporting process
Don't knowingly submit a false, misleading, malicious, abusive or duplicate complaint, and don't ask other people to duplicate a complaint already made for you.
We may reject a complaint that misuses the process, and we may also take proportionate action against the account that's responsible for serious or repeated misuse.
Repeat infringement
We may suspend or terminate an account for repeated infringement after weighing the nature, seriousness, frequency and context of the infringements and our legal duties.
Other rights and remedies
This guide doesn't limit any right or remedy you have under applicable law.
Section 14 of our privacy policy explains how we handle requests for user information from authorities and courts, including when we tell the people affected. Section 7.4 of the same policy says how long we keep reports and the records of what we decided.
