# Operator Pass terms

## 1. What these terms are about

These terms apply when you buy or have the Operator Pass, and when someone passes one on to you. Checkout shows them before you pay, and we email them to you as a PDF with your purchase confirmation so you can keep a copy.

They add to our [terms of service](https://canary.fluxer.com/terms.md) and replace part of it where they say so. The rest of the terms of service, the [community guidelines](https://canary.fluxer.com/guidelines.md) and the [privacy policy](https://canary.fluxer.com/privacy.md) still apply.

The Operator Pass is an optional one-time purchase that supports Fluxer, and we sell it on the web. One purchase can include up to 25 passes, and you can make as many purchases as you like. The price pays in full for your Operator certificate in section 2, a printable PDF that we deliver as soon as you have paid.

Everything that section 3 describes also comes with the pass. For legal and accounting reasons, the price pays only for the certificate, which we deliver in full at once. This is why we don't commit to offering any of those things for a set length of time, and we can change how any of them works as Fluxer grows, within the limits of section 3.

The seller is Fluxer Platform AB, a Swedish limited company with organization number 559537-3993 and its registered office (säte) in Haninge, Sweden.

## 2. Your Operator certificate

Your Operator certificate is a PDF file with one page for each pass you buy. Each page has its own certificate number, the name you chose for that page at checkout, the date and time you paid, and Fluxer Platform AB as the issuer. If you buy a pass for someone else, you can put their name on its page and later send just that page to them.

Each page also has its own private link, which is printed on the page. Anyone with the link can open a page on fluxer.com that shows the certificate number, the name on the page, the date and time of payment, when that copy was made and whether the page is still valid, and can open the PDF file of that page from there. In your settings, you can open each page, copy its link and replace the link with a new one.

When you replace a link, the old link stops working right away, and we give you a new copy of the page with the new link printed on it and the same number and date. The links and the page they open come with your certificate on top of what you pay for, and section 3 applies to them. Each page keeps its link even when you no longer have a pass, for example after you pass that pass on to someone else.

The certificate itself is in English, and we print each name on it exactly as you typed it. A business can put its own company name on the certificate.

Before you pay, checkout checks every name and turns down any name that looks like it comes from Fluxer, our team or another brand, or that the certificate can't print, for example because it has emoji. The certificate only shows that you supported Fluxer, and it doesn't mean that we endorse you or your business in any way.

The certificate is digital content. Once your payment goes through and we have emailed your confirmation, we create the certificate and make it available in your settings, within moments of your payment. We also email you a copy of the certificate.

For legal and accounting reasons, we treat the moment the certificate is in your settings as the delivery, because your right of withdrawal in section 7.1 and the way we record the income both depend on it. After it, nothing is left to deliver under this section.

You can keep, print and share your certificate and its links, and we never change a file once we have made it. Keep your own copy, because when your account is deleted we delete our copy of the file and the link of every page stops working.

If someone whose name you put on a page objects to it and the objection succeeds, as the [Operator Pass privacy notice](https://canary.fluxer.com/operator-pass-privacy.md) describes, we ask you for another name and give you a new copy of that page with the same number and date.

If you withdraw from a pass, its payment is refunded or reversed, or the Visionary it came with ends, our records show its certificate page as canceled, as sections 7, 9, 12 and 13 say. Your settings then leave that page out, and its link shows only the certificate number, the date and time of payment and that the page was canceled.

## 3. What else comes with the pass

Everything listed below comes with the pass on top of what you pay for, as this section describes. It all comes with the pass today, except the Operator mark, which comes once we have a list of Fluxer instances on our website.

- The Operator badge on your Fluxer profile, showing that you have a pass, your count and since when. You can hide the badge, or just its date, in your settings.
- A listing on the [Operators' wall](https://canary.fluxer.com/index.md), as sections 3.1 and 3.2 describe.
- The Operator role in Fluxer Labs and access to the #operators channel, where Hampus Kraft, creator of Fluxer, takes part when he can. The role also shows you in the Operators group in the member list, with its own role color. It doesn't let you post in any other channel where other members can't post.
- Invitations to test new features before they ship. Pre-release features can have bugs, so try them where a bug can't hurt you or your users.
- Your name in the yearly Operators list, as section 3.3 describes.
- An Operator mark on the listing of an instance you run in our list of Fluxer instances. Anyone who follows the listing rules can add their own instance to our list for free, and you never need an Operator Pass to be listed there.
- Inactive accounts that have what comes with the pass aren't deleted.
- If your name changes, a new copy of your certificate with the new name and the same number and payment date, from [our support team](https://canary.fluxer.com/company-information.md) whenever you ask.
- A private link for each certificate page, where anyone with the link can check that page and open its PDF file, as section 2 of these terms describes.

You have what comes with the pass while you have at least one pass on your account. Every Operator gets the same things, however many passes they have. Your count changes only your badge number and your size and place on the wall, and it gives you no extra access, support or priority. Section 13 says what Visionaries get through Visionary, whether or not they turn on the pass that comes with it.

We use your count for your badge and the wall. It includes the passes on your account. While you keep at least one pass on your account, it also includes the passes you bought and passed on. Each pass counts once per account, for buyer and recipient. Paused passes don't count, and an ended pass stops counting for both. You can hide the count, and settings show it separately from the passes you have.

The pass comes with a place in Fluxer Labs. When we deliver your certificate, or when a pass someone passed on to you arrives in your account, we add that account to Fluxer Labs with the Operator role. An existing member just gets the role.

Operators can talk in Fluxer Labs about Fluxer in general, including self-hosting, the API, bots and any instance they run. You can leave at any time, and if you leave or are removed from it, we won't add you again, even for another pass.

The #operators channel is a place to talk. For legal and accounting reasons, the price pays only for your certificate, so nothing in this section is a paid service with a set length, level or response time. The pass isn't a support contract, and Fluxer Labs has no guaranteed response time or service level. We don't log in to, run or look after any instance you run, and you stay responsible for it and its data.

We don't promise that any question gets an answer, that Hampus joins a given conversation, that every problem gets fixed or that a feature you ask for gets built.

We can change how any of these things looks and where it shows at any time. Over time, as Fluxer grows, we can also change, extend or reduce how any of these things works, or end any one of them for all Operators, but only for a good reason, such as low use, its cost, a legal or security problem, or a change in how Fluxer works.

This also applies to the wall, the yearly list and Pass it on. Sections 3.1 to 3.3 and 11 describe how they work today, and we can change or end them as this section says.

If a change makes something that comes with the pass more than a little worse for you, or ends it, we email you a reasonable time ahead. The email says what changes and when and any right the law gives you to end your purchase because of it.

Unless the law where you live gives you a right to one, you get no refund or other compensation when we change or end what comes with the pass. We take it away from a single person only for the reasons and in the way that sections 8 and 9 say.

### 3.1 Your listing on the wall

At checkout you choose the name and avatar for your listing, or choose not to be listed, and the badge turns on either way. We suggest your Fluxer display name and avatar, but you can use another display name or nickname, and you never need your legal name. The wall name is separate from the names on your certificate.

Your listing goes up when you pay and shows the name and avatar you chose. We can check any name or avatar on the wall at any time, and we can refuse a name when you choose it if it looks like the name of Fluxer, our team or another brand.

Unless you turn this off in your settings, your listing follows changes to your Fluxer display name and avatar, and each change shows on the wall when you make it. We keep copies of the names and avatars that you send us for the wall, together with their history, as the [Operator Pass privacy notice](https://canary.fluxer.com/operator-pass-privacy.md) describes.

We can take a name or avatar off the Operators' wall, or refuse a change to one, if it breaks the [community guidelines](https://canary.fluxer.com/guidelines.md), pretends to be someone else, uses a name or an image that you have no right to use, or is not suitable for the youngest people who are allowed to use Fluxer under section 1 of the [terms of service](https://canary.fluxer.com/terms.md).

When we take one off, the wall shows "Operator" and the default avatar instead. You stay on the wall with the same size and place as before, and you keep your badge, every pass you have and everything else that comes with the pass, exactly as they were.

Taking a name or avatar off never takes you off the wall for good, which we do only under [section 8](https://canary.fluxer.com/operator-pass-terms.md). We tell you what we did, why and how to appeal, as section 6.2 of the [terms of service](https://canary.fluxer.com/terms.md) describes, and you can choose a new name or avatar.

We can also shorten a long name or adjust how a name or avatar is shown so that it fits on the wall, for example by cutting it off at a set length, removing characters that don't display, or cropping the avatar. We always keep it recognizable as yours, and fitting it to the wall doesn't remove anything that comes with your pass.

While we look into a report or a possible breach about your listing, we can take it off the wall until we decide. We tell you what we did, why and how to appeal, your badge and passes stay, and the listing comes back at its size and place if we show it again.

In your settings or through [our support team](https://canary.fluxer.com/company-information.md), you can change your name or avatar on the wall, leave the wall, come back to it later or hide the badge on your profile. Choosing not to be listed, leaving the wall or hiding the badge has no effect on your certificate, and because the price pays only for your certificate, it gives you no refund.

Today Operators with a higher count appear larger and first. The four sizes are for counts of 1, 2 to 4, 5 to 9 and 10 or more. Within each size we order Operators by the earliest date of a pass that still counts for them, earliest first.

For passes you bought, we use the date we delivered the certificate, even if you later passed the pass on. For passes you got from someone else, we use the date the pass moved to your account. For the pass that comes with Visionary, we use the date you got Visionary. The date on your badge follows the same rule.

Sizes and places change as counts and dates change. Passing on a pass doesn't by itself lower your count or change its date if you keep a pass on your account.

### 3.2 Listing your business

If you bought passes for your business under section 4, you can ask us to list your business with its company name and logo instead of a name and avatar. If your VAT ID is from an EU country other than Sweden, VIES must have confirmed it.

Email [our support team](https://canary.fluxer.com/company-information.md) from the email address of the Fluxer account that has the passes, and send us the company name and a square logo for the listing. We can ask you to show that you have the authority to act for the business.

Business listings appear together after the listings of people, in their own area of the wall. They all have the same size, and their order follows the date rule in section 3.1, earliest first. A business listing replaces the personal listing of the account that bought the passes, doesn't follow changes to that account's profile and doesn't link anywhere. Business listings don't appear on the self-hosting page of our website.

A business listing uses the same count as a personal listing, under the rule in section 3. Passes bought by its account and passed on to staff count for both the business account and the recipients, as long as each account still has at least one pass on it.

A business listing shows only that the business bought passes. It is not an endorsement or a partnership either way, and it gives the business no say in what we build.

Section 3.1 applies to the company name and logo as it does to a name and avatar, including the reasons we can refuse them or take them off and how we fit them to the wall. We can also decline a business listing, or end one later, if showing it could make people think we recommend the business or work with it.

Examples are a business in gambling, adult content, weapons, drugs or political campaigning, or one that sells followers, accounts, reviews, links, academic work or spam. Until we approve a business listing, and whenever we decline or end one, the account keeps its listing with a name and avatar, and we tell you why.

By sending us a logo, you confirm that you can act for the business and that it has the rights to let us show the name and logo. You let us show them free of charge and worldwide on the wall, and in pictures and recordings of our website that show the wall, while the business listing is up. This gives us no other right to use them.

If someone tells us that a name or logo on the wall infringes their rights, we can hide it from the wall while we look into the claim. While it's hidden, the listing shows the word "Operator" and the default avatar until we decide what to do about the claim. Hiding it doesn't remove what comes with your pass. We tell you what we did and why, and you can reply to us or appeal the decision as section 3.1 describes.

To change the logo or go back to a name and avatar, ask us the same way. You can also leave the wall or come back to it, as section 3.1 describes.

If you change your wall name or avatar in your settings, the listing becomes a personal listing again right away, with that name and avatar. If we stop showing business listings, each one goes back to the account's listing with a name and avatar.

### 3.3 The yearly Operators list

Your name goes on every yearly list we publish while you have a pass on your account, are listed on the wall and have "Add my name to the yearly Operators list" on in your settings, which is off until you turn it on. The list uses your wall name at the time and goes into the release notes and a file in the Fluxer source code repository.

If you ask us to erase your name after a list has been published, we leave it out of all future releases, edit the published release notes to remove it, and remove it from the list file in the next change to the source code. Earlier versions in the history of the source code, and copies that others have made, can't be recalled.

### 3.4 What the pass doesn't give you

The pass unlocks nothing in the software. Self-hosted Fluxer works the same with or without the pass and stays free to run, and losing the pass never affects an instance you run. The pass gives you no Plutonium benefits, no hosting and no license or other rights in the software. The pass and the certificate have no cash value.

## 4. Price and payment

The price of a pass is shown on the [Operator Pass page](https://canary.fluxer.com/pass) and at checkout before you pay, including any tax that applies. You pay once and nothing renews, and section 4.1 of the [terms of service](https://canary.fluxer.com/terms.md) says how payment works. Each purchase is a one-time sale at the price shown when you pay, so if the price changes after you buy, we don't charge you more for that purchase, and we don't refund you the difference either.

During the early bird phase, the pass page and checkout show the early bird price, the last day it applies and the standard price that applies after that.

If you buy for your business, choose at checkout to buy as a business and add your company name, address and VAT ID. Doing so confirms that you are buying the passes for your trade, business or profession, and you get an invoice with those details on it. The total price you pay is the same as for any other buyer.

If your VAT ID is from an EU country other than Sweden, reverse charge applies to your purchase, and you account for the VAT yourself, as the invoice says. A business in Sweden pays Swedish VAT, which is already included in the price. Outside the EU, any tax that applies is also included in the price, and your invoice shows it.

We check EU VAT IDs with the European Commission's VIES service after you have paid. If VIES doesn't confirm your VAT ID, the total price you paid stays the same, you still bought for your business, and only our VAT accounting changes.

Your passes go to the Fluxer account you buy with. Your VAT ID appears only on your invoice. Your company name shows on the wall only if you choose it as your wall name or ask for a business listing under [section 3.2](https://canary.fluxer.com/operator-pass-terms.md), and never on your badge.

You can pass each pass on to another account under section 11, for example a staff member's, once you're friends on Fluxer, and this doesn't change your invoice.

## 5. How long the pass lasts

Your certificate is a file you keep, as section 2 says. For the legal and accounting reasons in section 1, we don't commit to offering what comes with the pass for any set length of time. We can change or end it in the ways section 3 describes, and all of it ends for everyone if we close down the official Fluxer service.

If we decide to close the official Fluxer service, we email you a reasonable time ahead. If Fluxer Platform AB or the official Fluxer service is sold or transferred to someone else, the new owner takes over these terms for every existing pass.

## 6. Mistakes in your certificate

If your certificate file is damaged, or it shows something different from what you typed or paid for because of a mistake on our part, tell [our support team](https://canary.fluxer.com/company-information.md) about it, and we send you a corrected copy with the same certificate number and payment date. Section 7.3 says what else the law gives you on top of that corrected copy.

## 7. Withdrawal and refunds

### 7.1 Withdrawal

If you buy as a consumer in the EU, the EEA, the UK or some other places, the law lets you withdraw from an online purchase within 14 days without giving a reason. For digital content such as your certificate, that right ends once delivery starts, if you asked for delivery before the 14 days ended and confirmed that you would lose the right.

For legal and accounting reasons, we need your request and confirmation, because we deliver your certificate at once, before the 14 days end, and the law above lets that delivery end your right to withdraw only when you have given both.

Before you pay, checkout asks you to check a box that is never checked for you, and you can't buy a pass without checking that box. By checking it, you ask us to deliver your certificate right away, before the 14 days end, and you confirm that you lose your right to withdraw from the purchase once it has been delivered to you.

Checkout also asks you to confirm that you're 18 or older or have a parent's or guardian's permission to buy, and you can't buy without that confirmation either.

Before we deliver, we email you a confirmation that repeats that box, with the time you checked it, the price and these terms, and that says you lose your right to withdraw once the certificate is delivered. We record your choices, your age confirmation, the time, the version of these terms, your IP address, your browser's user agent and your account. This lets us show later what you agreed to and when.

If our emails to your account's address bounce, so that we can't send you that confirmation, we don't create the certificate, we refund the whole payment to the payment method you used, and you can buy again once your email works.

Once we deliver your certificate, as section 2 says, you can't withdraw from the purchase, except where section 12 says otherwise. If we haven't delivered it yet, you can still withdraw from it. Use "Withdraw from contract here" next to the purchase in your settings, or tell us in any other clear way through [our support team](https://canary.fluxer.com/company-information.md). We confirm your withdrawal by email, with the date and time that we received it.

We then refund you in full within 14 days of your withdrawal, to the same payment method, and send a credit note if the purchase came with an invoice. Our records show those certificate pages as canceled, and what comes with those passes ends.

Because the law gives a right of withdrawal only to consumers, you have no such right under this section if you buy for your business, even if VIES doesn't confirm your VAT ID. Section 12 says what applies instead in some countries.

Someone who receives a pass under section 11 doesn't pay for it and has no right of withdrawal. They can decline the offer instead, as section 11 says.

### 7.2 Withdrawal form

While you can still withdraw, you can copy this form, fill it in and send it to <support@fluxer.com>. You don't have to use the form to withdraw.

> To Fluxer Platform AB, c/o Embassy House, Östgötagatan 12, 116 25 Stockholm, Sweden, support@fluxer.com:
>
> I/We (\*) hereby give notice that I/We (\*) withdraw from my/our (\*) contract for the Operator Pass.
>
> Ordered on (\*)/received on (\*):
>
> Name of consumer(s):
>
> Address of consumer(s):
>
> Email address of the Fluxer account (optional, it helps us find the purchase):
>
> Signature of consumer(s) (only if this form is sent on paper):
>
> Date:
>
> (\*) Delete as appropriate.

### 7.3 After delivery

For the legal and accounting reasons in section 7.1, purchases are final once your certificate is delivered, except where the law where you live gives you a right that can't be given up, as section 12 describes for some countries.

We may still choose to give a refund. For the Operator Pass, this section replaces sections 4.2 and 4.3 of the [terms of service](https://canary.fluxer.com/terms.md) on refunds and withdrawal.

Your statutory rights are not affected. You still get any refund or other remedy the law gives you, for example when we charge you the wrong amount or more than once, when someone used your payment method without your permission, or when your certificate isn't delivered or isn't as described here or on the pass page.

## 8. When we remove what comes with the pass

When we take what comes with the pass away from one person, we follow the rules in this section and give our reasons as the law requires. We can remove some or all of it, for a limited time or permanently, if you break these terms, the [terms of service](https://canary.fluxer.com/terms.md) or the [community guidelines](https://canary.fluxer.com/guidelines.md) anywhere on the official Fluxer service, including Fluxer Labs. Removing it never cancels your certificate, and you keep the file.

That includes misusing the #operators channel or the Operator role, such as by harassing the team or other Operators, sharing what others post there without their permission, advertising, or letting someone else into the channel. It also includes using your Operator role or badge to talk down to other people or to act as if you have authority over them. We judge a breach by the rules in force at the time.

For a minor breach, we start with a warning or a removal for a limited time, as section 9 of the [community guidelines](https://canary.fluxer.com/guidelines.md) describes. We permanently remove what comes with the pass only for a serious breach, such as threats, harassment, illegal content or fraud, for a breach after we have already removed it from you for a limited time, or for an unjustified payment dispute that [section 9](https://canary.fluxer.com/operator-pass-terms.md) treats as a serious breach.

Before we permanently remove what comes with the pass, we tell you why and give you 7 days to reply, unless the breach is serious enough that we must act at once.

If we terminate your Fluxer account because you broke our terms or the community guidelines, the pass ends with it. Section 2 says what happens to your certificate. We take you off the wall for good only when we permanently remove what comes with the pass, and never just because we took a name or avatar off under [section 3.1](https://canary.fluxer.com/operator-pass-terms.md).

We remove what comes with the pass only for the reasons in these terms.

When we remove what comes with the pass, you get the statement of reasons that section 6.2 of the [terms of service](https://canary.fluxer.com/terms.md) describes, including how long the removal will last, and you can appeal under that section, including through the out-of-court route that our [DSA dispute help](https://canary.fluxer.com/help/dsa-dispute-resolution.md) describes. Because the price pays only for your certificate, which you keep, we give no refund when we remove what comes with the pass.

If we permanently remove what comes with the pass, you can't buy a pass or receive one again. Removing it doesn't suspend your Fluxer account by itself, and any measure on your account follows section 6.2 of the terms of service.

If the appeal shows that we got it wrong, we give back what comes with the pass, with the original date on your badge. We also give it back if a measure that we took on your Fluxer account together with the removal is later reversed on appeal.

As a consumer in the EU or the EEA, you can also take a dispute about a removal to the Swedish National Board for Consumer Disputes, as [section 14](https://canary.fluxer.com/operator-pass-terms.md) describes.

## 9. Payment disputes and chargebacks

You can always dispute a charge with your bank or card issuer, and these terms never stop you. If a pass payment is wrong, the fastest fix is to tell [our support team](https://canary.fluxer.com/company-information.md).

Because a disputed payment can still be reversed, we limit what you can buy while a dispute is open, to protect against fraud and chargebacks. While a dispute about any payment you made to us is open, you can't buy a pass.

While a dispute about a pass payment is open, you also can't buy anything else on Fluxer, and we pause the pass. You can buy again as soon as the dispute closes, and we may ask you for the information that we need to respond to it.

When we believe a dispute is wrong, we contest it and show your bank the record of your choices at checkout in section 7.1, the business details you gave if you bought for your business, the confirmation email and when we delivered the certificate.

If the dispute closes without the money being returned to you, including when you drop it, we restore the pass and nothing happens to your account.

If the money goes back to you, every pass paid for by that payment ends and stops counting, and our records show their certificate pages as canceled. This also applies to passes you passed on to someone else, as section 11 describes.

Other payments are not affected, except as the paragraphs below on unjustified disputes say. When an account's last pass ends, what comes with the pass ends for that account too, and we take its badge and listing down. If a pass was passed on to someone else, the buyer also loses the credit for that pass.

A person on our team checks every dispute about a pass payment while the dispute is open. A dispute is unjustified only when you or someone you allowed made the payment, we charged the right amount, we delivered the certificate as these terms and the pass page describe, we had not refunded the payment, and your right of withdrawal under [section 7.1](https://canary.fluxer.com/operator-pass-terms.md) or 12 had ended when you disputed the payment.

A dispute is always justified in each of the cases below, and it never leads to any action against your Fluxer account beyond the pause described above.

- Someone used your payment method without your permission.
- We charged you the wrong amount or more than once.
- We had already refunded the payment.
- We did not deliver the certificate, or it was not as described.
- You withdrew under section 7.1 or 12 and we did not refund you.
- The ground that your bank or card company gives for the dispute is that the payment was not made by you or by someone that you allowed, that we charged you the wrong amount or more than once, that we did not process a refund that we owed you, or that the certificate was not delivered as described.

If you dispute because we changed or ended something that comes with the pass, or because of a removal under [section 8](https://canary.fluxer.com/operator-pass-terms.md) that you believe was wrong, we may contest the dispute with your bank. We never treat such a dispute as unjustified, and we take no action against your Fluxer account beyond the pause described above.

If we find a dispute unjustified, we tell you by email and in a message in Fluxer, with our reasons and a date a few days before we have to answer your bank.

If the dispute isn't dropped before that date and it ends with the money returned to you, that is a serious breach. The passes paid for by that payment end for good, as above, and we permanently remove what comes with the pass from the paying account under [section 8](https://canary.fluxer.com/operator-pass-terms.md), so that account can't buy or receive a pass again.

This doesn't close your Fluxer account or change anything else on it. We take action against your account over a payment only for fraud or another breach that section 6.2 of the [terms of service](https://canary.fluxer.com/terms.md) covers, and that section explains how. You can appeal under that section, and if the appeal shows the dispute was justified, we give back what comes with the pass, and you can buy or receive a pass again.

If our payment provider warns us a pass payment was likely fraudulent, we refund it, report it to the provider and block the payment details used, and the pass that payment paid for ends. The warning alone never leads to action against your Fluxer account.

## 10. Deleting your account

A pass belongs to the account that has it. If you delete your account, every pass on it ends when the deletion completes after the grace period in section 6.1 of the [terms of service](https://canary.fluxer.com/terms.md), any offer you made under section 11 is withdrawn, and we take your listing down. Because the price pays only for your certificate, as section 1 says, deleting your account doesn't give you a refund for any of its passes.

To keep a pass, pass it on under section 11 before the deletion completes. Your certificate stays yours, but once your account is deleted we delete our copy of the file and its links stop working, so download the certificate first.

## 11. Pass it on

Pass it on is one of the things that come with the pass, and section 3 applies to it. You can pass on a pass that you bought to another Fluxer account, and that account then has what comes with it. The certificate page for that pass stays exactly as it was printed, and its link stays in your settings, not in theirs. Section 2 says how you can give someone a certificate page with their own name on it.

The other account must be your friend on Fluxer when you offer the pass and when they accept it. Each pass can be passed on only once, and a pass you received can't be passed on again. A pass that came with Visionary can't be passed on at all, and a pass can't go to an account that lost what comes with the pass under section 8.

Until the pass moves, it stays yours and you can take the offer back. When they accept, they accept these terms and choose a wall name or not to be listed, and the pass moves to them. Their badge turns on and their listing goes up, or their count goes up if they already have a pass, and from then on these terms apply to them for that pass.

After the move, the pass still counts for you as its buyer under the count rule in section 3. It also counts for the recipient, from the date we move it to them. This doesn't give you any ownership of, or control over, the pass you passed on.

We can keep a pass on your account after the other person accepts, or end the offer, while the payment for that pass has a fraud warning, an open dispute or a refund, or while we look into possible fraud involving that payment.

If you pass on your only remaining pass, your Operator badge, your listing on the wall and everything else that comes with the pass go away, and we ask you to confirm this first. The passes you passed on don't keep any of it for you. Once you have at least one pass again, the valid passes you passed on count for you too.

Passing a pass on is not a sale. You get no refund or payment for it, and the other person pays nothing. The purchase stays yours, and any refund the law or these terms give for it goes to you, to the payment method you used. If the payment for a pass is refunded or reversed, that pass ends for whoever has it, as section 9 describes. Sections 3, 5, 8 and 10 apply to whoever has a passed-on pass as if they had bought it.

That person has no right of withdrawal of their own, as section 7.1 says, and can decline the offer instead. Once a pass has moved to another account, it belongs to that account. A business that passes a pass on to a staff member can't take it back, and the pass stays with that person if they leave the business.

## 12. Rules for some countries

Some countries give consumers a right to withdraw from an online purchase that can't be given up, even after delivery. For a country this section lists, the right it describes replaces the rule in section 7.1 that ends your right to withdraw on delivery.

**Brazil.** If you have a billing address in Brazil or pay in reais, you can withdraw until 23:59 Acre time (UTC-5) on the 7th day after delivery and get a full refund of what you paid, even though we deliver your certificate within moments of your payment.

If you buy for a company and enter its CNPJ at checkout, this rule doesn't apply, unless Brazilian law treats the company as a consumer. When we can tell before you pay that this rule applies to you, the box you check at checkout tells you this.

To withdraw, use "Withdraw from contract here" next to the purchase or the withdraw link under a pass in your settings, or tell us in any other clear way through [our support team](https://canary.fluxer.com/company-information.md). We confirm your withdrawal by email. We refund the full price of each pass you withdraw from right away, to the same payment method you used.

If you paid by Pix, the refund goes back to the account the Pix payment came from. We also send a credit note if the purchase came with an invoice. Our records then show those certificate pages as canceled, and what comes with those passes ends.

**Australia.** For consumers in Australia, section 7.3 means we give no refunds for a change of mind. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law, and a major failure entitles you to a refund.

## 13. Visionary

Your Visionary already includes access to read and post in #operators in Fluxer Labs. You keep that access whether or not you turn on your pass, and nothing in these terms reduces or takes away what you bought with Visionary.

Section 3 lets us change or end what comes with the pass, but not that access. If we close #operators, Visionaries keep their own channel in Fluxer Labs for self-hosting.

Visionary comes with an Operator Pass. From November 1, 2026, you can turn it on under "Operator Pass" in your settings. You choose the name for your certificate then, and its page shows the date you got Visionary instead of a payment date.

When you turn it on, you get an Operator certificate and everything else that comes with the pass, like everyone else, on these terms, and you pay nothing more for it. Turning it on only adds these things and takes nothing away from Visionary. The pass in your Visionary can't be passed on to someone else, as section 11 says.

Turning on your pass isn't a new purchase, so sections 4 and 7, on paying for a pass and on withdrawal and refunds, don't apply to the pass in your Visionary. Your Visionary payment isn't a pass payment, so section 9 doesn't apply to it. Turning on your pass doesn't change any right the law gives you for your Visionary purchase.

If your Visionary payment is refunded or reversed, or your Visionary ends for another reason, the pass in your Visionary ends too. Our records then show the certificate page for that pass as canceled, as section 2 of these terms describes.

Until you turn on your pass, the rest of these terms don't apply to you.

## 14. Changes and contact

We can change these terms, and we record every change in our [changelog](https://canary.fluxer.com/changelog.md).

Because what comes with the pass is not what the price pays for, changing or ending it under section 3 is not a change to these terms. The rules in section 8 on removing it from one person are part of these terms, so they change only as this section says.

A change that leaves you worse off applies to a pass you already have only for a valid reason, such as a change in the law, a security or abuse problem or a change in how Fluxer works, and only after we email you about it a reasonable time in advance. Such a change never reduces or takes away what section 13 says Visionaries keep.

These terms are written in English. If the Brazil rule in section 12 applies to you, the Portuguese version applies. Otherwise, where we provide a translation as a service, the English version applies to the extent the law allows. You can find every contact route, including our support email address, on our [company information page](https://canary.fluxer.com/company-information.md).

If you are a consumer in the EU or the EEA and we cannot settle a complaint about the pass with you, you can take it to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), Box 174, 101 23 Stockholm, Sweden, [arn.se](https://www.arn.se). ARN takes a case only after you have first raised it with us.
